November 17, 2014--Co-Equal?

Flipping channels the other morning in search of anything other than the local weather forecast and reports about gridlocked traffic, I paused for a moment on MSNBC to see how their post-election post-mortem was proceeding.

They had already concluded that there was no chance of anything bipartisan happening between a cranky Republican Congress and an equally grumpy Barack Obama, who was about to issue a series of executive orders to deal in part with our immigration mess.

John Boehner was sputtering that if the president did this the GOP would fight him "tooth and nail," some of his members gleefully chiming in in the background that this could lead to Obama's impeachment; while over in the Senate, about-to-be Majority Leader Mitch McConnell said that if Obama signed those executive orders it would "be like waving a red flag in front of a bull" and could easily lead, McConnell threatened, to yet another government shutdown.

Boehner I ignored--he has his Tea Party members to contend with; but I took McConnell at his word because if there is anything he knows about it's bull.

One of the MSNBC panelists pointed out that Obama acting as promised would assure nothing gets done since, "in our system," the federal government is made up of "three co-equal parts" and unless there is some semblance of working together it will mean that more than the traffic will be gridlocked.

Really, I thought. Have the MSNBC folks read their Constitution recently?

In fact, in great detail, whatever we think of it, the Constitution goes to great length to make certain that the three branches of our government will be anything but equal or, if you prefer, co-equal. And to assure that the Congress, which at least theoretically most represents "the people," in fear of European-like monarchal tyranny or dominance by corrupt and unrepresentative courts, our Founders took care to structure things so that Congress would be preeminent.

Not the executive branch and not even the Supreme Court. In fact, creating the Supreme Court was an afterthought on the part of the Framers. That's how much they despised and feared the potential power of a corrupt judiciary. And so they severely limited its powers. As they did the presidency, again, for fear of tyranny.

Congress has the exclusive power to enact laws (forget executive orders which by their nature are constitutionally questionable--something we may see tested if Obama does his immigration thing) and once passed and approved the executive, like it or not, the president must enforce. Indeed, though bills passed by Congress must be approved by the president, if they are vetoed, the Congress still has the ultimate authority to enact them by voting to overturn that veto. And if the president refuses to follow the Constitution he can be impeached and removed from office. By Congress. As can Supreme Court and other federal judges. Again, solely by Congress. Only voters can get rid of even felonious or demagogic congressmen.

This doesn't sound co-equal to me.

What about the president's constitutional prerogatives as Commander in Chief? Doesn't that make him preeminent? Not really.

When the Constitution was written in 1787 the new republic didn't have a standing army and so there was very little for the Commander in Chief to command. In fact, the Framers were reluctant to agree to a standing federal militia or navy. That too they saw to be a threat to representative government. Again, looking toward Europe, it was the last thing they wanted.

It is only since the Second World War when, because of the advent of nuclear weapons and ballistic missiles and the speed with which they can be launched, that so much retaliatory power has accrued to the presidency. But, again with the necessary acquiescence of Congress. It is felt that the national security state that we have become requires such powers be granted to the president. But, if Congress disapproves of presidential military ventures it has the exclusive power of the purse--only Congress can authorize governmental spending.

This doesn't sound co-equal to me.

And when it comes to the Supreme Court, it too is a bit less than supreme. True, for the most part, when they rule it becomes the so-called "law of the land." But they rule about very little and even if and when they do, if Congress does not like a ruling it can pass other similar laws designed to get around SCOTUS rulings and, if that fails, amend the Constitution. Admittedly this is a rare and arduous process, but still the power resides with the Congress (and the states) to change if they wish our most sacred document.

Again, this doesn't sound co-equal to me.

Like it or not, the structure of the government we have is not as viable as it was in the sleepier 18th, 19th, and even 20th centuries. But it is what we have. Governmental gridlock was not something to be avoided, but was a desired part of the process. A relatively weak and unintrusive federal government is what our Founders intentionally framed for us and though we now know how intrusive an unfettered government can be, because of checks and balances, an ineffective government with a dominant Congress is what we have. Just what was intended.

October 30, 2013--Garrison State


I've been reading about President Eisenhower--a more interesting and complex man than popularly remembered. He was not just an overachiever--supreme commander of allied forces during the Second World War or the bumbling political amateur who in 1952, mainly through his open smile, was elected to the first of two terms as president.
He may have seemed more interested in playing bridge than governing and may have appeared to be more focused on his putting than foreign affairs, but that is a self-deprecating image he carefully cultivated. He famously said to an aide just before a critical press conference, "Don't worry, I'll confuse them." And he did!
By pretending to be less than he in fact was, he enhanced his power to steer the country through perilous times. Recall, he served during the height of the Cold War when there was the real possibility that America and the Soviets would become involved in a civilization-ending nuclear war.
He is best known and most highly regarded by liberals for his farewell address in which he warned about the spreading power of the "military-industrial complex." But there is more in that speech, largely overlooked, that offers additional lessons for our own time--Eisenhower's concern that in our fear of an atomic attack by the Soviets we would become what he called a "garrison state"; and in so becoming, run the danger of losing basic civil liberties and irrevocably altering the democratic character of our country.
At the time, policymakers and the public had little reliable information about the nature of the Soviet threat and this uncertainty added to the fear citizens felt. This fear, among some, turned into paranoia, Red-baiting witch-hunts, and calls for unbridled military spending to meet the unknown and therefore menacing nature of Soviet military power.
Eisenhower was concerned that fear-driven loose talk about the nature of Soviet intentions could in itself be dangerous to U.S. security. He felt that Soviet capacity for war was being overstated by self-interested military leaders and demagogues such as Senator Joseph McCarthy. 

Additionally, he contended, there was a high price to pay for exaggerating Soviet motivations. That paying too much attention to the alleged military potential of the Soviet Union would turn the United States into a state armed beyond our needs; deeply in debt because of all the military spending; with the economy, as a result, dominated by the arms race. And, because of the fear of external, and more significant, purported internal enemies, we were in danger of seeing our civil liberties eroded.

As, during the Red scare, they were.

From his farewell address, in Eisenhower's words—
Until the latest of our world conflicts, the United States had no armaments industry. American makers of plowshares could, with time and as required, make swords as well. But now we can no longer risk emergency improvisation of national defense; we have been compelled to create a permanent armaments industry of vast proportions. Added to this, three and a half million men and women are directly engaged in the defense establishment. We annually spend on military security more than the net income of all United States corporations. 
This conjunction of an immense military establishment and a large arms industry is new in the American experience. The total influence – economic, political, even spiritual – is felt in every city, every statehouse, every office of the federal government. We recognize the imperative need for this development. Yet we must not fail to comprehend its grave implications. Our toil, resources and livelihood are all involved; so is the very structure of our society.
We would do well today to heed these words. 

We are becoming a national security state in which most of our resources are being diverted to defense spending. Fearing terrorism--as Americans in the 50s feared communism and Soviet threats--the public is passive as we spend most of our national treasure on weapon systems we do not in fact need; run up massive debts to pay for them; and, most distressing, overwhelmed by fear, seem complacent when an every-expanding government tramples on constitutional rights to privacy and free expression.

September 5, 2013--Smart Piece From a Good Friend

I asked a good friend what he would do about Syria if he were commander-in-chief. As always with him, I got much more than I asked for. And, as usual, it was very smart--
I'm a little light on answers here. I think it is much more complicated now by Obama's red line that it was before. I'm also trying to sort out how to approach this. 
If you look at it from where we are right now, where we have a lot of involvement in the Middle East behind us, even with a lot of shaky results, the choices -- bomb or not -- look one way, within that framework. But if you think that such a level of involvement is too much or otherwise ineffective or ill advised, then you get different questions. What exactly should the US be doing outside its borders, anyway? As far into Middle Eastern affairs as we are now, it is harder to take a step back, much harder than it would have been even 10 years ago. I think Obama has produced a situation surrounding Syria with no really good options. 
My own preferences have long been running toward a much more modest role for the US in world affairs, and I'm very skeptical whether an attack has any real strategic effect in this environment. Chemical weapons are horrible, but I think more and more that we're better served leaving other countries to their own devices and horrors, rather than trying to intervene in conflicts where we can't even identify the players and issues. It's hard to watch a government kill its civilians -- this all started with peaceful, Cairo-style Arab Spring demonstrations -- but I don't feel comfortable with an intervention. Obama hasn't made a strong case for the strategic benefits of intervening or even that it would change anything in Syria. 
Another part of this whole development over many decades of involvement via the Executive branch is the terrible effect this has had on democracy in America. The Executive has seized a lot of power over a long period, and Congress has given away its prerogatives to the Executive with both hands. It can't seem to surrender its powers fast enough, even as many there rattle on and on about the sacred and perfect Constitution we are supposed to have. 
We seem to have built a national security state of huge proportions, capable of wiping out any and all parts of the Bill of Rights without even a challenge, taking us into wars on its own motion. The security/terrorism threat -- back to the Middle East -- has been the basis for changing how this country really works. Start adding some of the developments coming from corporate influence in politics and elsewhere into the mix, and the country starts to look way different from what we want to think. 
The security state has been bankrupting us, hurting the economy, damaging political freedom at home, and now has us trying to figure out whether another Middle East intervention is essential or not. Less empire, more focus on international trade and investment systems, standards issues, resolution of conflict, a better model for social justice at home -- that all seems more productive to me.
